Family Domain Name Registration?

For years I have been trying to get my family name domain from a scum-bag company that has one of those idiot parking sites sitting there.

They refuse to give the name up and I’ve offered to purchase it but I always receive the response that it’s not for sale because it is a "premium 5-letter domain name". There is no reason anyone would want it for anything unless you’re one of my family members (which as far as I know is strictly American because of name changes after immigrating), which I am and wish to use it for the family (reunion photos, information, history, lineage, networking, email, etc…)

My first question is one that I probably know the answer to already: does our family have any rights to owning this domain, kind of how companies have sued in the past to obtain the rights to domain names which they had registered. Is there any precedence for this, how would it be determined which family member had the rights? The company is not, and in the 7 or more years that I’ve been contacting them has never, legitimately used the site for anything than a placeholder.

Second question, so that I can come up with an idea of pricing, how much would be a reasonable offer for a 5-letter domain name which is a pretty obscure family name but means nothing outside of that context? I mean, it’s not like my last name is Miller or Jones.
